房屋的所有權(quán)人為業(yè)主。
業(yè)主在物業(yè)管理活動中,享有下列權(quán)利:
(一)按照物業(yè)服務(wù)合同的約定,接受物業(yè)服務(wù)企業(yè)提供的服務(wù);
(二)提議召開業(yè)主大會會議,并就物業(yè)管理的有關(guān)事項提出建議;
(三)提出制定和修改管理規(guī)約、業(yè)主大會議事規(guī)則的建議;
(四)參加業(yè)主大會會議,行使投票權(quán);
(五)選舉業(yè)主委員會成員,并享有被選舉權(quán);
(六)監(jiān)督業(yè)主委員會的工作;
(七)監(jiān)督物業(yè)服務(wù)企業(yè)履行物業(yè)服務(wù)合同;
(八)對物業(yè)共用部位、共用設(shè)施設(shè)備和相關(guān)場地使用情況享有知情權(quán)和監(jiān)督權(quán);
(九)監(jiān)督物業(yè)共用部位、共用設(shè)施設(shè)備專項維修資金(以下簡稱專項維修資金)的管理和使用;
(十)法律、法規(guī)規(guī)定的其他權(quán)利。
The owner of the house is the owner.
Owners enjoy the following rights in property management activities:
(1) to accept the services provided by the realty service enterprise in accordance with the provisions of the realty service contract;
(2) to propose the convening of a meeting of the owners' general meeting and make recommendations on matters related to property management;
(3) to propose the formulation and modification of the management regulations and the rules of procedure of the owners' meeting;
(4) to attend meetings of the owners' general meeting and exercise the right to vote;
(5) to elect members of the owners' committee and to have the right to stand for election;
(6) to supervise the work of the owners' committee;
(7) supervise the performance of realty service contracts by realty service enterprises;
(8) it shall have the right to know and supervise the use of the common parts, facilities and equipment of the realty and related sites;
(9) to supervise the management and use of special maintenance funds (hereinafter referred to as special maintenance funds) for common parts and common facilities and equipment of the realty;
(10) other rights prescribed by laws and regulations.
